个人资料保护通知

PMCK Berhad and its subsidiary, Klinik Pergigian UNIK, is subject to the personal data protection principles under the Personal Data Protection Act 2010 (the PDPA) with effect from 15 November 2013, which regulates the processing of personal data in commercial transactions. The terms “personal data”, “processing” and “commercial transactions” have the meaning provided in the PDPA.

It is obligatory that you supply us with your personal data. If you fail to do so, we may not be able to process or disclose your data for the purposes set out in item C below. This Notice applies to any person whose personal data is being processed by Klinik Pergigian UNIK and its related entities under PMCK Berhad.

A) Source of the personal data

Your personal data is collected from various sources, including information you have provided us, information from third parties and information in the public domain.

B) Description of the personal data

Your personal data processed by us may include, where relevant: name, date of birth, identity card or passport, name of employer or company, home and office address, telephone and mobile number, facsimile number, email address, occupation, age, gender, marital status, weight, height, photographs, race, nationality, religion, family and next of kin information, consultation records, dental records, dental examination results, Medical Record No. (MRN), dental reports, diagnosis, treatment records, personal health information, radiographic and investigation results, insurance details, and any other personal data required for the purposes set out in item C below.

C) Purposes of the personal data

Your personal data may be processed for the following purposes, where relevant:

1. For the provision of dental, oral healthcare and related services.
2. To facilitate patients’ dental healthcare and related administrative requirements, including referrals and continuity of care.
3. To establish, maintain and manage patient dental records, consultation records, radiographs and dental reports.
4. To facilitate payment processes relating to patients.
5. To institute debt recovery proceedings against defaulters.
6. To report, submit or disclose personal data to relevant authorities and authorised third parties as required under laws, regulations and professional requirements applicable to dental clinics and dental healthcare services.
7. To provide information regarding dental services, oral health programmes, preventive dental care initiatives, promotional activities and other services offered by Klinik Pergigian UNIK, subject to applicable laws and consent requirements.
8. To administer and respond to requests, queries, complaints and legal issues.
9. To facilitate human resource management activities relating to employees.
10. For submission and registration of relevant forms, notifications, permits, licences and records to the relevant authorities under the governing laws applicable to dental facilities and dental clinics.
11. To facilitate billing, payment processing, insurance claims, financial transactions, legal documentation and accounting processes where applicable.
12. For any other purpose incidental to or in furtherance of the above.

D) Disclosure of the personal data

Your personal data may be disclosed to the following parties, where relevant:

1. Healthcare professionals, including dental practitioners (as defined in the PDPA)
2. Government agencies, local authorities, non-government agencies
3. Employers, paying agents and insurance providers/agents
4. Debt collection authorities and agencies
5. Financial institutions
6. Legal firms
7. Auditors
8. Vendors, contractors and service providers engaged by Klinik Pergigian UNIK
9. Other private and public hospitals, dental clinics, medical clinics and healthcare facilities
10. Dental practitioners, laboratories, radiology providers and other healthcare providers involved in referrals, investigations, diagnostic services, treatment or continuity of care
11. Training providers
12. Family and next of kin
13. Other parties as may be required by law, court, regulator or legal processes
14. Other parties as may be permitted under the laws of Malaysia
15. Any other person or organisation where such disclosure is necessary for the purposes stated in this Notice or as permitted or required by law

E) Access and update

We shall do our best to ensure that the personal data we hold about you is accurate, complete and up to date. If there are any changes to your personal data, or if you believe that the personal data is inaccurate, incomplete or not up to date, please contact us so that we may take steps to update it.

You have the right to access your personal data. If you would like to request access, please contact us. We recommend that your request for access to personal data held by Klinik Pergigian UNIK and/or PMCK Berhad be made in writing. We may also take steps to verify your identity before fulfilling your request.

In accordance with the PDPA:

1. Depending on the information requested, we may charge a fee as stipulated in the First Schedule (Regulation 2) of the Personal Data Protection (Fees) Regulations 2013 for processing your request for access; and
2. We may refuse to comply with your request to access or make a correction in accordance with the PDPA.
